The obvious goal of this bill is to outlaw the barbaric procedure known as dismemberment abortion – a procedure that a majority of the public views as unacceptable.
As part of our efforts to support the right to life, we have analyzed every pro-life bill that has been filed in the South Carolina General Assembly during the current legislative session.
Our goal is to inform our readers about these bills and to give them an understanding of their purpose. We believe life is a precious gift from our Creator and that it should be valued and protected under the law from conception to natural death. That’s why we support any and all efforts to reduce abortion in South Carolina.
The next stop on highlighting legislation within the Palmetto State that seeks to protect the life of the pre-born, we turn our attention to H.3779 known as the “South Carolina Unborn Child Protection from Dismemberment Abortion Act.”
This bill has been introduced by Representative Lin Bennett from Charleston. If this bill sounds familiar to our readers, it’s because in 2017 it suffered a devastating setback in the state senate when members from the pro-choice camp decided to amendment the bill which changed the bill’s intent and resulted in a failed floor vote.
Representative Bennett re-filed the bill for this legislative session, and it is currently waiting a hearing in the House Judiciary Committee.
This bill would outlaw the horrendous practice of abortion by dismemberment in South Carolina and make it a felony for any doctor to perform such a horrific procedure. Any doctor who performs such an abortion would face jail time and a $10,000 fine.
The bill defines dismemberment abortion as:
“’Dismemberment abortion’ means, with the intention of causing the death of an unborn child, knowingly to dismember a living unborn child and extract him or her one piece at a time from the uterus through use of clamps, grasping forceps, tongs, scissors or similar instruments that, through the convergence of two rigid levers, slice, crush, and/or grasp a portion of the unborn child’s body to cut or rip it off.”
This bill also allows fathers and grandparents to seek punitive damages from a doctor and their staff who conduct such a procedure, and it layouts how one would be prosecuted.

The intent of this bill is not to allow or justify abortions by other procedures, but to instead contribute to the effort to outlaw all abortions.

Our conviction and intent is to support any pro-life piece of legislation which seeks to save even just one life.
